BRAY RUN SUMMARY OF CONDITIONS, COVENANTS & RESTRICTIONS ON LOTS
- Single family residential purposes only. No temporary buildings at any time.
- No Lot shall be subdivided.
- Minimum 1,500 square feet of living area is required above ground.
- Exterior construction must be completed within 12 months of ground breaking.
- No Structure may be erected or begun, nor shall the appearance of any Structure be changed or altered, until the plans, costs, schedule, specifications have been submitted to and approved in writing by the Architectural Committee.
- Between the hours of 11:00 p.m. and 8:00 a.m., no Owner or occupant of a Lot shall make any loud or unusual noises
which may become an annoyance or nuisance to the neighborhood. (Early a.m. construction is accepted).
- No household garage or trash shall be stored in the open on any Lot unless when it is contained within approved receptacles.
- Setbacks from the property shall be those specified on the plat and is limited to the building envelope.
- The Board of the Association shall have the right to prescribe reasonable rules and regulations governing the use of Common Areas, which shall be applied equally to all Owners.
- No clear cutting of any Lot is permitted, except those tress which must be removed to allow construction of a residence or a driveway on a Lot in accordance with Architectural Committee permission. Penalties for unauthorized cutting include fines and replanting.
- Every Owner shall be a member of the Bray Run Property Owners Association.
- The Common areas will be owned by the Association with every Owner having a right to the use of the Common Areas, roads, open space, streets, trails, sports court and playground within the property.
- The annual assessment for each site will be $350.00. The annual assessments shall commence as to all Lots on the first day of July 2008. The first annual assessment shall be fixed by the Board of Directors and shall be adjusted according to the number of months remaining in the calendar year. All lots owned by the Declarant will not be subject to the annual assessment.
- No signs of any kind shall be erected within the subdivision, unless approved by the Architectural Committee.
- All vehicles, boats, trailers, campers, may be parked only in private driveways. No boats, recreational vehicles, unlicensed automobiles, junked vehicles, or trucks rated more than ¾ ton, may be parked or stored within the subdivision for longer than fourteen days in any calendar year unless parked or stored in an enclosed garage.
- Dogs, cats or similar domestic household pets may be kept so as to avoid becoming a nuisance to the neighborhood and if they are not bred or maintained for any commercial purpose.
BRAY RUN ARCHITECTURAL GUIDELINES
In order to simplify the Architectural Committee review process, at least one copy of the information identified in the following checklist must be submitted as a minimum package for review including one full size set of blueprints and one 8 ½ x 11 (or similar). Many committee members may reside on a full-time basis outside of Garrett County and we can mail the submission if we have a suitable size for reproduction and mailing.
- Complete sets of professionally prepared blueprint scale drawings, including elevations of all exterior walls of proposed dwelling. (2 sets of you want on returned with your approval). One full size to scale; one set sized 8 ½ x 11.
- Site plan, drawn to scale, showing location of proposed improvements including: house, garage (if one), driveway, decks, parking areas and distances from buildings at all lot lines. Also, site plan to show North direction. Setbacks from adjoining properties shall be those specified on the plat approved by the Developers and the Planning Commission (when applicable) and is limited to the building envelope as show thereon. Setbacks from roadways are a minimum of 20’. Setbacks to preserve neighbor’s views are designated on the plat, however, the Architectural Committee reserves the right to adjust house locations in order to preserve neighbor’s potential views. The setbacks as designated on the plat shall be shown on the site plan. If a plat does not indicate a building envelope, then the setbacks are prescribed by the Deep Creek Lake Watershed Zoning Ordinance shall apply. Height of residence: The mean height shall not exceed 30’ unless approved in advance by the Architectural Committee. Building height is the vertical measurement from the mean level of the ground abutting the building to a point midway between the highest and lowest points on the roof. As-Built Foundation Survey: Required from owner or builder prior to completion of foundation walls to verify compliance with setbacks and preliminary approvals.
- Information on exterior materials, including siding, fascia, decks, roofing, spouting, foundation, patios/porches, walkways, etc. Note: Exterior sidings and railings must be of natural materials or an approved substitute. Exterior colors must be approved by the Architectural Committee and should be earthtone colors. Color samples must be provided. Main roof pitches must not be less than 8:12. Fascia and trim detail must be provided and approved by the Architectural Committee. Roofing materials – Standard – Shall be a minimum of a 25-year architectural shingle and in earthtone colors. Metal Roofs may be approved only with standing rib seam construction and in muted earthtone colors. Cedar shakes are permitted. Other materials are subject to review and approval by the Committee. Deck and Porch railings – Details shall be provided and approved by Architectural Committee; stains and colors shall also be approved by the Architectural Committee.
- Landscaping plan and exterior lighting plan. Lights should be designed to prevent neighbor interference. (Note: These plans may be submitted near the end of the building construction period.)
- Proposed construction schedule (construction of exterior must be completed within one year).
- Plan for excess excavation material. Under no circumstances may any improvements or casting of soil be allowed on 30% slopes (areas outside of the approved building envelopes).
- Prior to start of construction, designation of party or parties to perform the work must be submitted to the Architectural Committee.
Special Requirements
- No above-ground fuel tanks are permitted.
- Driveway culvert must be at least 20 feet long and scaled to handle water flow.
- A port-a-john must be at construction site for use of workers.
- No vinyl siding or plywood siding board (4x8’s) is permitted – only natural wood or approved substitute.
- Public sewer is available to each lot through the Garrett County Sanitary Commission; one ERU fee for sewer is included with the lot price.
- Exposed foundations – Any exposed portion of a foundation greater than 18 vertical inches shall be covered with earthtone natural material siding, natural stone veneer, or other approved treatment.
- Please remember that no living tree larger than 4” diameter may be removed without permission of the Architectural Committee. Trees that are removed for lake view improvement must first be flagged, inspected and approved by the Architectural Committee. Trees within 20’ of a subdivision roadway must be preserved.
- All residences shall have a minimum of 1,500 square feet of finished living space, excluding decks and basements. Areas with ceilings under 6’0” shall not be counted as living space.
The Architectural Committee reserves the right to disapprove any plans that do not meet these Architectural Guidelines. However, the approval of plans by the Architectural Committee in no way relieves the lot owner or house builder from compliance with any approvals necessary from applicable government authorities, including the zoning office. Also, building plans are not reviewed for structural soundness but only with regard to local building practices and aesthetics. The Committee assumes no responsibility for actual building techniques or standards.
